These Terms & Conditions (“Terms”) form a binding legal agreement between you (“Participant,” “Client,” or “you”) and Pinnacle, MycoMeditations, JamTravel Enterprises, Inc., Accelerated Performance Consulting, and their respective affiliates, subsidiaries, successors, and assigns (collectively, the “Affiliated Companies,” “we,” “our,” or “us”).By accessing our websites, submitting an application, making a payment, or participating in any of our programs, you agree to be bound by these Terms. If you do not agree, you must refrain from using our services.

1. Scope of Services
   • 1.1 Pinnacle and the Affiliated Companies offer leadership development programs combining executive coaching, online learning, proprietary assessments, and psilocybin-enhanced retreats.
   • 1.2 Services are designed for professional growth and personal development. They are not medical treatment, psychotherapy, or clinical healthcare services.
   • 1.3 We reserve the right to modify, suspend, or discontinue any service or program at our sole discretion, with or without notice, including changes to program structure, facilitators, venues, or schedules.
2. Eligibility & Applications
   • 2.1 Participation requires that you are at least 18 years of age or the legal age of majority in your jurisdiction.
   • 2.2 By applying, you warrant that all information provided (including health disclosures, professional background, and contact details) is true, complete, and not misleading
   • 2.3 Acceptance into any program is at the sole discretion of Pinnacle and the Affiliated Companies. We reserve the right to deny applications or remove participants where participation may pose health, safety, or reputational risks.
   • 2.4 Providing false or incomplete information is grounds for denial or termination of participation without refund.
3. Participant Responsibilities
   • 3.1 You agree to follow all safety protocols, program rules, and facilitator guidance provided before, during, and after participation.
   • 3.2 You agree not to engage in behavior that could endanger yourself, other participants, staff, or affiliates, including disruptive, abusive, or unlawful conduct.
   • 3.3 You agree to respect the confidentiality of all other participants and not disclose personal or sensitive information shared during programs.
   • 3.4 You acknowledge that outcomes from participation are subjective, vary widely, and cannot be guaranteed.
4. Health & Safety Acknowledgements
   • 4.1 You acknowledge that participation in psilocybin-enhanced retreats involves psychological and emotional intensity, including experiences that may be challenging or destabilizing.
   • 4.2 Programs are not a substitute for medical or psychiatric care. We do not diagnose, treat, or cure any disease or mental health condition.
   • 4.3 You are responsible for consulting your own healthcare providers about participation and must disclose relevant health history as requested.
   • 4.4 Pinnacle and the Affiliated Companies reserve the right to deny participation if health disclosures indicate elevated risk.
5. Fees, Payments & Refunds
   • 5.1 Fees must be paid according to the terms provided at registration. Participation may be withheld until payment is received in full.
   • 5.2 Certain programs may allow staged or installment payments. Failure to meet payment obligations may result in forfeiture of participation rights.
   • 5.3 Refund and cancellation policies are communicated at booking. Unless otherwise specified, all fees become non-refundable once the program has begun.
   • 5.4 We reserve the right to adjust pricing, add surcharges, or revise payment terms at our discretion.
6. Intellectual Property
   • 6.1 All content, assessments, program structures, written materials, logos, trademarks, recordings, and related intellectual property are owned or licensed by Pinnacle and the Affiliated Companies.
   • 6.2 You are granted a limited, non-exclusive, non-transferable license to use materials solely for personal participation.
   • 6.3 You may not copy, share, distribute, record, or create derivative works from program materials without express written permission.
   • 6.4 Unauthorized use of intellectual property may result in immediate legal action.
7. Confidentiality & Non-Disclosure
   • 7.1 Participants may share personal experiences during group discussions. You agree to maintain the confidentiality of all such information and not disclose it outside the program.
   • 7.2 Program materials and proprietary methods are confidential and may not be shared, published, or distributed without written consent.
   • 7.3 Pinnacle and the Affiliated Companies will safeguard your personal information in accordance with our [link to Privacy Policy].
8. Limitation of Liability
   • 8.1 To the maximum extent permitted by law, Pinnacle, MycoMeditations, JamTravel Enterprises, Inc., Accelerated Performance Consulting, and all Affiliated Companies disclaim liability for:
     • Indirect, incidental, or consequential damages, including but not limited to emotional distress, financial losses, reputational harm, or data loss.
     • Injuries or conditions arising from voluntary participation, including psychological or physical effects of psilocybin.
   • 8.2 No warranties or guarantees, express or implied, are made regarding specific outcomes.
   • 8.3 Aggregate liability of Pinnacle and the Affiliated Companies for any claim shall not exceed the fees paid for the specific program giving rise to the claim.
9. Indemnification
   • 9.1 You agree to indemnify, defend, and hold harmless Pinnacle, MycoMeditations, JamTravel Enterprises, Inc., Accelerated Performance Consulting, their officers, employees, contractors, affiliates, and partners against any claims, liabilities, damages, or expenses arising from:
     • Your participation in programs;
     • Your breach of these Terms;
     • Your negligent, unlawful, or disruptive actions.
10. Privacy & Data Handling
    • 10.1 We collect, store, and process data in accordance with our [link to Privacy Policy].
    • 10.2 You consent to the transfer of data internationally where necessary for program delivery, data storage, or operational purposes.
    • 10.3 While we implement reasonable safeguards, no digital or physical system is fully secure, and you accept associated risks.
11. Third-Party Providers
    • 11.1 Programs may involve third-party vendors (e.g., accommodations, transport, facilitators, assessment providers, and payment processors).
    • 11.2 Pinnacle and the Affiliated Companies are not responsible for the conduct, omissions, or errors of third-party vendors, whose services are governed by their own policies.
12. Force Majeure
    • 12.1 None of the Affiliated Companies shall be liable for delays or cancellations caused by events beyond their reasonable control, including natural disasters, pandemics, government restrictions, labor disputes, or technological outages.
    • 12.2 In such cases, we may modify, postpone, or cancel services without liability, though we will make reasonable efforts to offer alternative arrangements.
13. Dispute Resolution
    • 13.1 Parties will first attempt good-faith negotiation to resolve disputes.
    • 13.2 If unresolved, disputes shall be submitted to binding arbitration under the rules of Jamaica and held in Jamaica.
    • 13.3 You waive the right to bring or participate in class actions or collective proceedings.
    • 13.4 Any claims must be filed within one year of the event giving rise to the dispute.
14. Governing Law
    • The laws of Jamaica govern these Terms. For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the courts in Jamaica.
15. Severability
    • If any provision is found to be invalid or unenforceable, the remaining provisions shall continue in full effect.
16. Modifications
    • We may revise these Terms at any time. Updates will be posted with a new Effective Date. Continued participation constitutes acceptance of the revised Terms.
17. Entire Agreements
    • These Terms, along with the Privacy Policy and any written agreements provided at registration, constitute the entire agreement between you and the Affiliated Companies and supersede all prior agreements, whether oral or written.
